Child Support and Taxes
Child support is not tax deductible to the person paying support and is tax free to the recipient. Therefore, the recipient and the minor children get the full benefit of the money paid for child support. This differs from alimony (maintenance), which is normally tax deductible to the payor and taxed to the recipient (of course the tax bracket of the recipient might be low, creating a relatively small income tax liability for the maintenance recipient). We are not accountants, and are not providing tax advice. We recommend that anyone seeking a divorce consult with an accountant before making decisions based on tax consequences.
